Terms and Conditions for ASU Graduation Photos

Please carefully read the following terms and conditions that apply to your ASU Graduation Photo session:

Booking and Rescheduling:

1. Complimentary Reschedule:

Clients are entitled to one complimentary reschedule if the request is made at least 36 hours before the scheduled session. Rescheduling requests made less than 36 hours before the session will be considered on a case-by-case basis and may incur an additional fee.

2. Additional Reschedules:

Any additional rescheduling requests after the first complimentary reschedule will incur a fee of $20. These requests must be made at least 36 hours in advance to allow for rebooking.

Weather Exclusion:

3. Inclement Weather Policy:

In the event of inclement weather or other adverse conditions, sessions may be rescheduled without penalty. We will work with you to find an alternative date that suits both parties.

4. Weather-Related Rescheduling:

Rescheduling due to weather conditions will not count towards the complimentary reschedule limit.

Deposits:

5. Non-Refundable Deposit:

A non-refundable deposit is required to secure your booking. This deposit is used for session planning and preparation and will not be refunded under any circumstances.

6. Deposit Payment:

The deposit is due at the time of booking and must be paid to confirm your session date and time.

Late Arrival Policy:

7. Late Arrival Impact:

If a client arrives late, the session time will be reduced accordingly and will not extend past the agreed-upon booking time. This policy ensures respect for other clients who have scheduled sessions after yours.

8. Session Time Allocation:

Late arrivals will not be compensated with extended session times. The photographer will make every effort to utilize the available time effectively, but the total session time will be limited to the original booking

Client Notification:

9. Notification of Delay:

Clients must notify the photographer as soon as possible if they anticipate being late. Delays may impact the number and variety of images delivered.

Impact of Late Arrival on Images:

10. **Reduction in Image Variety:**

Late arrivals may limit the number of poses and settings that can be captured. The photographer will strive to deliver high-quality images within the reduced timeframe.

Full Rate Charge:

11. Rate Obligation:

The full agreed-upon rate will be charged regardless of late arrival or adjustments to the session time.

No Refund Policy:

12. Refund Policy:

No refunds will be issued for late arrivals, cancellations, or no-shows. The non-refundable deposit will be forfeited in such cases.

Cancellation and No-Show:

13. Cancellation Policy:

Cancellations made within 24 hours of the scheduled session, excluding weather-related cancellations, will result in the forfeiture of the deposit.

14. No-Show Policy:

Failure to attend the scheduled session without prior notice will result in the forfeiture of the deposit and may impact the ability to book future sessions.

Image Delivery and Editing:

15. Delivery Timeframe:

Final edited images will be delivered within an estimated timeframe of 5-14 days, depending on the time of year:

- Sessions shot during January-March & August-October typically have a faster delivery time (approx. 7 days).

- Sessions shot during April-May & November-December may experience longer delivery times.

16. Additional Edits:

Your package includes the agreed-upon number of final images. Additional edits or special requests beyond the initial scope may incur extra costs.

Usage Rights:

17. Personal Use:

Clients are granted rights to use the images for personal purposes, including sharing on social media and printing for personal display.

18. Commercial Use:

Any commercial use of the images, including advertising or promotional purposes, requires a separate agreement and may incur additional fees.

Client Cooperation:

19. Session Participation:

Client cooperation is essential for achieving the best results. Clients are expected to follow the photographer’s directions and participate actively in the session.

Location Permissions:

20. Responsibility for Permissions:

Clients are responsible for obtaining any necessary permissions or permits for locations not suggested by the photographer. Failure to secure required permissions may result in rescheduling or session location changes.

Payment Terms:

21. Payment Methods:

The remaining balance is due during the session. Accepted payment methods include Zelle, Cash, Venmo, and Credit/Debit. Please note, a 4% fee will be applied for card payments.

22. Automatic Payment:

If payment is not completed during the session, the client agrees to automatic card payment once the gallery is delivered.

Special Requests:

23. Advance Communication:

Any specific requests or preferences must be communicated to the photographer in advance to ensure they can be accommodated within the session time.

Additional Fees:

24. Travel Fees:

Additional fees may apply for travel outside a [20-mile] radius from ASU Tempe. Extended sessions or special requests may also incur additional charges.

25. Extended Session Fees:

Fees for extended sessions will be agreed upon in advance and paid at the time of the session.

Photographer's Portfolio:

26. Image Showcasing:

The photographer may showcase select images from the session in their portfolio, on social media, website, print, etc., unless the client requests otherwise in writing.

Client Responsibilities:

27. Readiness and Timeliness:

Clients must be punctual and prepared for the session. Delays or lack of preparation may affect the session outcome.

Force Majeure:

28. Unforeseen Circumstances:

In the event of unforeseen circumstances (force majeure) affecting the session or image delivery, both parties will work together to find a suitable solution or reschedule as necessary.**Communication:**
